If you are selling your Spanish property, you will need a lawyer to:
- Draft the purchase contract between the buyer and yourself.
- Complete the sale of your property at the Notary.
- Cancel all direct debits
- Claim back the 3% non-resident retention. (If you have not made a gain the property, and you have paid your non-resident taxes for the last four years).
 
For the completion of your sale:
- You will be required to allow the buyers' solicitor to retain what is called the Plusvalia - similar to Capital Gains Tax. 
- You will need to have all utilities bills paid up to date.
- If the property has a mortgage, we will cancel it for you on the day of completion.
- You will need to provide the buyer’s solicitor with up to date Habitation and Energy Certificates. 
- If the property has had any alterations or extensions they will need to be registered by the day of completion, together with an Architect’s Certificate.
- You will also need to provide a Community Certificate (stating Community fees are paid up to date) if relevant
- Deeds from the property purchase, Utility Bills, Habitation and Energy Certificates, Copy of passports & NIEs and Community Details are all needed for the completion of this sale.
